PRIVACY NOTICE FOR CLIENTS

Studio Marine SRL – Excursion and Transport Services Pursuant to Arts. 13-14 of EU Regulation 2016/679 (GDPR)

2. PURPOSES OF PROCESSING

Your personal data are processed for the following purposes:

  • Performance of the excursion/transport service agreement and related contractual obligations
  • Tax, administrative, insurance and safety compliance
  • Pre- and post-experience communications (confirmations, updates, feedback)
  • Emergency management and assistance during the service
  • Use of images for promotional purposes (only if authorised)

Legal basis for processing:

  • Performance of a contract (Art. 6.1.b GDPR)
  • Legal obligations (Art. 6.1.c GDPR)
  • Explicit consent for images (Art. 6.1.a GDPR)

3. CATEGORIES OF DATA PROCESSED

Personal and contact details: Name, surname, date and place of birth, address, phone number, email

Identity documentation: Type and number of identity document (for legal compliance purposes)

Health data (for emergency and safety purposes only): Information on medical conditions relevant to safety during the experience (e.g. allergies, chronic conditions, pregnancy, physical limitations, ongoing drug therapies)

Purpose of health data processing: Solely to ensure participant safety during the service and to manage any medical emergencies. Health data are not used for commercial, marketing or profiling purposes.

Legal basis: Art. 9(2)(a) GDPR (explicit consent) or Art. 9(2)(c) GDPR (vital interests)

Access to health data: Access is limited exclusively to authorised personnel directly involved in service delivery (drivers, guides, crew, safety officer). Health data are stored separately from other personal data and protected with enhanced security measures.

Retention and deletion of health data: General health data are deleted within 30 days of the end of the service. In the event of injuries, accidents or medical emergencies, data relating to the incident are retained for 5 years for legal, insurance and civil liability purposes.

Service-related data: Type of experience booked, chosen itineraries, dietary requirements, special requests

4. PROCESSING METHODS

Processing is carried out using paper and/or digital tools, with organisational and logical procedures strictly linked to the purposes indicated and in a manner that ensures the security and confidentiality of the data.

Data are accessible only to:

  • Authorised Studio Marine SRL personnel (administration, drivers, guides, crew)
  • External professionals engaged where necessary (accountant, insurer)

Data are not disclosed to unauthorised third parties.

5. DATA RETENTION

Personal data are retained for the time necessary to perform the contract and fulfil legal obligations:

6. DISCLOSURE AND TRANSFER

Data may be disclosed to:

  • Competent authorities (Harbour Master's Office, law enforcement, supervisory bodies) where required by law
  • Insurers for claims management
  • Necessary technical service providers (e.g. secure payment platforms)

Transfer outside the EU: Data are not transferred outside the European Union, except where strictly necessary and with adequate safeguards pursuant to the GDPR.

7. DATA SUBJECT RIGHTS

Pursuant to Arts. 15-22 GDPR, you have the right to:

  • Access: obtain confirmation of processing and a copy of your data
  • Rectification: request correction of inaccurate data
  • Erasure (right to be forgotten): request deletion of data when no longer necessary
  • Restriction: request restriction of processing in specific cases
  • Portability: receive data in a structured format and transfer it to another controller
  • Objection: object to processing on legitimate grounds
  • Withdrawal of consent: withdraw at any time consent given for images or consent-based processing

8. RIGHT TO LODGE A COMPLAINT

If you believe that the processing of your data infringes the GDPR, you have the right to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it) or with the supervisory authority of your country of residence.

9. IMAGE CONSENT (OPTIONAL)

  • I CONSENT to Studio Marine SRL using photos and videos in which I appear, taken during the experience (catamaran excursion, Land Rover tour, transfer or other activity), for promotional and marketing purposes (website, social media, brochures, advertising materials).

  • I DO NOT CONSENT to the use of images in which I appear.

Consent is freely given, optional and may be withdrawn at any time by writing to amministrazione@studiomarine.it
